Terms of use

These terms are between you or your organization and Rubicon Microproducts Inc. (info@rubiconmp.com), the owner and operator of DayBy. By using DayBy you accept them. If you do not accept them, do not use the platform.

Rubicon Microproducts Inc. provides DayBy, an attention-monitoring platform for families, schools and clinics. It offers interactive attention and impulse-control tests, stores the results of the people you monitor, and shows progress over time on charts.

Tests can be tried without an account; in that case results are shown on screen only and are not stored.

The platform also offers care-team discussions, a public forum, clinician profiles, downloadable reports and optional AI progress summaries. Availability depends on your plan and the access granted to your space. Our Privacy policy explains how these features handle information.

DayBy tests are observation aids. They do not diagnose ADHD or any other condition, and they do not replace the judgment of a qualified health professional. Never start, stop or change any treatment based on a DayBy result.

Reports, charts, forum discussions and AI summaries are not medical advice. AI drafts may be inaccurate or incomplete: review them before sharing with a clinician. DayBy is not an emergency service.

Test results depend on the device, browser, environment and the person's state on the day. We work to keep the platform reliable but cannot guarantee it is complete, current or free of error, and we do not guarantee uninterrupted availability.

Keep your access credentials secure and do not share them outside your organization.

Only add people to your space if you are authorized to do so: as their parent or guardian, or under your school or clinic's own policies and consents. Do not attempt to disrupt the platform, access data belonging to other organizations, or use the platform in breach of applicable law.

The platform itself (its software, tests, structure and presentation) is our property and is protected by copyright. The data you enter about the people you monitor, and their test results, remain yours; you can ask us to export or delete them.

Choose carefully who you invite to a space and which schools or clinics you allow to access a child's profile. Shared access can include test history, charts, reports and care-team posts. Only share information you are authorized to disclose. Downloaded reports and copies already shared outside DayBy cannot be recalled by removing access inside the platform.

The forum is public and can be read without an account or indexed by search engines. Do not post children's names, identifying details, private test results or other confidential information there. Forum authors are displayed by role, but the content you write can still identify you or someone else. Do not post harassment, unlawful content, spam or misleading medical claims. Posts can be reported and hidden or removed for misuse.

Subscriptions are sold by Rubicon Microproducts Inc.. Only a space's owner can change its plan. Paid plans are billed in advance in Canadian dollars (CAD), at the price shown at checkout. Family plans offer monthly or annual billing; school and clinic plans are billed monthly. Subscriptions renew automatically until cancelled.

You can cancel at any time. Cancellation stops the next renewal; access to paid features continues until the end of the period you have already paid for.

After paid access ends, your profiles and test history are kept. Adding people above the free plan's limit is paused; cancellation does not itself delete your data. The free plan's feature limits apply again. You can request deletion separately as described in our Privacy policy.

Plan changes, including upgrades, downgrades and switches between monthly and yearly billing where offered, take effect at the next renewal, without mid-period proration. Your current paid period remains in effect until then. Use the Billing page to manage your space's subscription and review renewal details.

Prices are shown exclusive of sales tax, VAT or GST where applicable; the applicable tax is calculated and added at checkout based on your location.

Payments are processed by Stripe. Your bank statement may show LINK.COM* followed by our statement descriptor. Applicable sales tax, GST or VAT is calculated and added at checkout based on your location.

The payment terms shown by Stripe at checkout apply to your purchase. Card details are entered directly with Stripe and are never held by us. For product support, contact Rubicon.

We offer a 30-day money-back guarantee. If a paid plan is not right for you, request a full refund within 30 days of the order date.

We may suspend or end access where there is a material breach of these terms, non-payment of fees due, a security or fraud risk, or repeated or serious misuse of the platform.

When access ends you can ask us to export the content your space created; after a reasonable export window it may be deleted.

To the extent permitted by law, we are not liable for indirect or consequential loss, or for decisions made on the basis of test results without the involvement of a qualified professional.

We may update these terms; continued use after an update means you accept the updated terms.
